A new lawsuit alleges DHS agents drove by observers' and protestors' homes to intimidate them and added their names to Homeland Security's investigations system, according to Wired.

ICE was presumably established by an act of congress. If the law which created it is interpreted to be broad enough to allow the dismantling of free assembly, then the law is definitionally unconstitutional. Good luck getting fuck all done about it, though!

So, where does this all fit: Congress didnt really make a law doing that. Executive branch policy changed ICE’s protocols until that’s what we have.
