New TOS basically say Meta can scrape all your stuff.
If anyone is still on Facebook, fuck them. They deserve all of this shit.
Holy shit! I thought this just applied to Whatsapp, but, no, it’s is literally all your stuff anywhere on the web:
The terms, which apply to business users on Facebook, Instagram, and other Meta properties, include a new paragraph that authorizes Meta to scrape any web pages associated with the user’s products or services, as well as content available through those pages. Meta says it can then use that data for product development or training of AI models.
The only question isn’t how broadly or specifically the provisions in the new agreement will be interpreted but where are businesses going to move to? because this is absolutely a red line for any creative business.
Honestly, any “creative business” that still does business through Mark Zuckerberg should have corrected themselves years ago. The next best time is today.
With these new terms, any creative business left on Facebook and IG needs to be called out for agreeing to Meta’s terms. This is the line artists can’t pass. Staying on Meta is scab behavior.
Doing business with Meta at all should be a reputational liability.
That does not seem legally binding to me at all. At least it‘s in no way plausible that using one service could grand them ownership of your private information or intellectual properties anywhere on the web. I mean I am no lawyer but this is just asking to get sued big time on Meta‘s part.
There is nothing plausible about our laws in the US. Our court precedents are often in open contempt of the Constitution and our laws in service of the rich.
The courts were captured via the federalist society, decades back and it’s getting worse. Part of the terms are that you can’t sue and instead can only use binding arbitration of their choosing, the supreme court officially blessed this, formerly illegal, maybe ten or so years back.
Edit: Wording for clarity
Since previous TOS allow them to change the TOS at any time without warning, does that mean an abandoned, or account put on hold, automatically is made to agree to this?
This kind of stuff only was allowed by the courts in the last couple decades plus. In the Bush years. Courts used to throw out entire contracts for one illegal part, now they legalized those things and allow the rest to remain in place if part is illegal.
They are asking for permission now?
No, they declare they’re doing it in the ToS but bury it so virtually nobody actually sees it and knows about it.
Yup, click OK and they can “legally” use all that stuff they already scraped and used.
Meta never asked for permission before, why would they start now?
Because eventually there’s going to be a reckoning, and they want to cover their ass
LOL in what world?
The one where AI has no liability framework, which means no organization can be blamed for anything?
It’s an unstable state. Meta can survive the AI bubble collapsing, they’ll even be in a good position afterwards since most of their rivals have put their necks out for AI
And when the bubble collapses, there’s going to be a bunch of regulation pushed to soothe the public anger and no more mountains of money to block it
there’s going to be a bunch of regulation pushed to soothe the public anger
I mean they clearly couldn’t give a single fuck about “public anger”?
They do when it includes the portion of the public with money.
And a lot of money is going to be lost, including rich people’s money. And that’s something that leads to consequences
How old are you? Do you not remember the 2008 financial crisis? Bankers committed fraud to the extent of causing a global financial crisis and recession. Who saw consequences for that? No one. The government just rewarded them with a bailout.
So they can officially use the information they already collected for commercial purposes.
